On Wednesday, October 19, 2011, Mayor Vincent Gray signed an executive order reaffirming a longstanding position that District police and other public agencies will not cooperate with Immigration and Customs Enforcement (“ICE”) to determine whether an alleged offender is in the country illegally. The executive order provides that District police and corrections officials will not ask persons about their immigration status, enforce an ICE detainer or warrant issued against individual who has not committed another crime, or contact ICE to have the federal agency investigate the legal status of someone who has been arrested. Instead, police officers are to process all offenders in the same manner and leave it to the FBI and ICE to decide whether to check on his or her legal status. If ICE elects to detain an offender upon his or her release from jail, the agency has 48 hours, excluding weekends and holidays, to pick up the alleged undocumented immigrant from custody.
